The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice, and all Agreements: "Client", "You", "Your", “Visitor(s)”,and “user(s)” refers to you, the person who logged on this Application and is compliant with the Company’s terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us",refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves.
These terms and conditions outline the rules and regulations for the use of Uttamam, a mobile-based application, operated and managed by UTTAMAM TRADING PRIVATE LIMITED, having its office at Shop No. 4, Jahajgarh Road, Sector-106, Gurugram, 122017 Haryana
The terms are recorded in terms of the Information Technology (IT) rules 2021 as notified by Government of India and this article comes under Rule 3 (intermediary’s guidelines). By accessing this mobile application, it is assumed that you accept these terms and conditions.
The Service as well the Infrastructure of this Application is equally accessible for persons with disability in accordance with the Section 40 and Section 46 of Rights of Persons with Disability Act, 2016.
These terms and conditions are applied to both existing and future customers of the company. By clicking on the OTP button and by verifying the OTP on your registered mobile on the platform you agree to be bound by the same and acknowledge that it constitutes an agreement between you and the company. The company retains complete rights to change the same without any prior notice to the user. We keep updating our terms & conditions from time to time and it is strongly recommended to read the same whenever you visit the platform.
Services
You acknowledge to use our services/platform/marketplace including the products that we sell to our customers.
The company has complete rights to modify/change the services at any point of time without any prior notice to the customers. So, it is recommended to visit the section to read the updated services, before accessing the platform.
Eligibility of Use
As per the Indian Contract Act 1872 the person who is under 18 years of age is not allowed to use the services. By entering into our platform you are agreeing that you are above legal age to use the services. If you are under 18 then we strongly advise you to use the services under the guidance/ supervision of parents/ guardians.
By using the UTTAMAM platform users might be exposed to content that might be objectionable or otherwise inappropriate, in that case, you may not use the services provided by the Uttamam, if you don’t wish to be bound by such Terms and Conditions.
Pricing
All the products listed on the app/website will be sold at MRP unless otherwise specified. The prices mentioned at the time of ordering will be the prices charged on the date of the delivery.
You shall be responsible for payment of all fees/costs/charges associated with the purchase of products from us and you agree to bear any and all applicable taxes.
Objectionable Material
You understand that by using ‘UTTAMAM’ app or any services provided on the ‘UTTAMAM’ app , you may encounter content that may be deemed by some to be offensive, indecent, or objectionable, which content may or may not be identified as such. You agree to use the Application and any service at your sole risk and that to the fullest extent permitted under applicable law, SGSPL and/or IRCPL and its affiliates shall have no liability to you for content that may be deemed offensive, indecent, or objectionable to you.
Trademarks
All the trade names associated with us and all products and logos denoted with TM are trademarks or registered trademarks of the Company or its Affiliates. Our trademarks shall not be used in connection with any product or service that is not our product or service.
Rich App
• By signing up with Uttamam Trading Private Limited, you agree to receive communication on WhatsApp, push notifications, SMS, Email, Customer Support Call, App and Website. You abide by the terms and conditions mentioned in the app.
• Uttamam Trading Private Limited may at any time modify the terms and conditions mentioned in the app. You can still access the latest version of the Terms and Conditions at any given time. We recommend you to regularly review the Terms and Conditions. If the Terms and Conditions are not acceptable to you, please feel free to reach out to the Uttamam support team.
Products Pricing & Offers
• Product prices listed on the app are dynamic, and can be changed at any time.
• To avail flash deal, the minimum order amount should not be less than ₹200.
• Free delivery can be availed by customer on order value of above ₹200 only.
• On an order value below ₹200 delivery charges will be applicable.
• Hourly flash deals’ prices vary according to the timing & stock availability.
• Two coupons cannot be combined together.
• Packaging & Handling charges will be applicable on all products.
Terms and conditions for receiving calls and SMS (Short Message Service)
These terms ensure smooth communication services while protecting the rights and privacy of both parties. Below are some common terms and conditions:
• You acknowledge and provide consents to receive calls and SMS from the company and its partners or affiliates.
• The content of the calls and SMS complies with relevant laws and regulations and does not contain offensive, misleading, or harmful material.
• No charges are associated with receiving calls or SMS.
• Users is provided with the option to opt-in or opt-out of receiving promotional calls and SMS.
• Company should adhere Privacy laws and regulations regarding the collection, storage, and use of personal information obtained through calls and SMS.
• Measures should be in place to protect users' personal information and prevent unauthorized access to call and SMS data
• User can lodge complaints on our support number regarding unwanted or inappropriate calls and SMS.
• The company reserves the right to update or modify the terms and conditions, with proper notice to the users.
Uttamam Weight Refund Policy
• Applicability: This weight refund policy pertains to fresh produce, specifically selected fruits and vegetables, procured through the Uttamam platform. Uttamam retains the authority to ascertain which products qualify for a weight refund under this policy.
• Minimum Refund Value: Customers become eligible for a weight refund only if the calculated refund value equals or surpasses Re 1. The amount for each item will be rounded down to the nearest rupee.
• Calculation Methodology: The weight refund calculations are conducted separately for each item, comparing the delivered weight with the weight indicated on the application at the time of order placement. The cumulative total of these individual calculations will then be applied to the entire order. This ensures a precise and itemized approach to the refund process.
• Refund Disbursement: The approved weight refund amount will be credited to the customer's Uttamam wallet.
License
Unless otherwise stated, Uttamam and/or its licensors own the intellectual property rights for all material on Uttamam. All intellectual property rights are reserved. You may access this from Uttamam for your own personal use subjected to restrictions set in these terms and conditions.
You must not :
• Republish material from Uttamam.
• Sell, rent, or sub-license material from Uttamam.
• Reproduce, duplicate, or copy material from Uttamam.
• Redistribute content from Uttamam.
• Use any data mining, robots, or similar data gathering and extraction tools.
• Utilize any information related to the company marketplace or/and of its affiliate(s) without any written consent from the company.
• Try to gain access to Uttamam platform/marketplace by any illegal means.
Termination
This User Agreement is effective unless and until terminated by Uttamam. You may terminate this User Agreement at any time, provided that you discontinue any further use of this Site. Uttamam may terminate this user agreement at any time and may do so immediately without notice, and accordingly deny you access to the application, such termination will be without any liability to Uttamam. Upon any termination of the user agreement by either you or Uttamam, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under the user agreement or otherwise. Uttamam's right to any comments shall survive any termination of this user agreement. Any such termination of the user agreement shall not cancel your obligation to pay for the product already ordered from the mobile application or affect any liability that may have arisen under the user agreement.
Refund & Return Policy
Uttamam does not facilitate any return policy, though; we have a refund policy that would be provided only when there would be some quality issue with the product being delivered as per the discretion of Uttamam.
Platform Fee
• Platform Fee of ₹5 will be applicable on all orders.
• Platform Fee is subject to change and can be changed by Uttamam any time without any prior notice
